A DUI is two problems at once

Pennsylvania treats a DUI as a criminal case and a PennDOT license case. The stop, the field tests, a breath or blood test, or a refusal can all show up in the file. People also search the tiers they see on the paperwork: general impairment, high rate, and highest rate, including drug DUIs.

A first offense is what most people search, including whether ARD is available. ARD is not automatic. A prior DUI, a crash, or a refusal changes the conversation. The license suspension can run even when someone is hoping the criminal charge will be reduced.

What to have from the stop

Send the citation or complaint, the county, the date of the stop, and whether there was a crash or an injury. Say if a blood test was taken at a hospital. Do not guess the result if you do not have it.

Nothing on this page is a prediction of what a case is worth, and it is not legal advice. A message asks the desk to review the facts and refer them.

What to send

A DUI stop creates a criminal case and a license problem at the same time. Send the citation, the county, and the first date.

The useful first facts are the place, the date, the court if there is one, and what happened. Records can wait until a lawyer asks for them.

How a referral works

A message asks the desk to read the facts and refer them to a lawyer who handles this work. It does not hire that lawyer, and it does not create an attorney-client relationship.

The lawyer who receives the introduction decides whether to take the matter and talks with you about deadlines and fees.
