Macek v. DraftKings, a class action, was dismissed by a federal judge in Pennsylvania in March 2026. The plaintiffs appealed to the U.S. Court of Appeals for the Third Circuit. Separately, on September 16, 2026, DraftKings moved four individual lawsuits from the Philadelphia Court of Common Pleas into the federal court in Philadelphia: Rivera, Santos, Woodson, and Evans.
The individual complaints are product-liability and consumer claims by bettors about their own losses and alleged addiction. They are allegations. DraftKings has not been found liable in those cases.
